Turkish Citizenship By Investment From The Perspective Of Lawyers
As Ketenci&Ketenci, we are a leading Turkish law firm working internationally. We have vast Turkish immigration and corporate law experience. We understand each of our client's specific requirements, and compelling needs and provide advice accordingly, in line with the Turkish immigration law.
As Turkish Citizenship lawyers, we would like to present certain issues to be considered for your information on the process of acquiring Turkish Citizenship:
o Nationality
Article 35 of Law on Property numbered 2644 references several regulations which restrict certain foreigners from acquiring property in Turkey. For example, according to one of these regulations, Syrian nationals cannot own property in Turkey. Therefore, it is important to determine whether the nationality of the client is among the banned nationalities. As Ketenci & Ketenci Lawyers, we make a detailed examination of each client's nationality as per current regulations in order not to face such a problem and make sure about their suitability for citizenship application.
o Chosen Property
There are certain criteria that must be met by the property. It is important to state that the choice of the property is the most important stage for applicants because if there are any restrictions on the Title Deed before the transfer, problems would arise during the process of acquiring Turkish Citizenship. The property must also have a valuation report which indicates the property has a market value of an amount of minimum of $400.000 USD. It would be advisable for applicants to work with a real estate lawyer to guarantee their investment. Ketenci & Ketenci ILP has expert lawyers working in the field of real estate for many years and has a real estate team who can present you with approved real estate projects which are completely appropriate to proceed with Turkish Citizenship.
o Required Documents and Attestation Procedures
Required documents to be submitted must be original or certified true copy. Documents issued by the foreign countries can be valid if they shall either be apostilled or if/where this is not possible, then the documents have to be certified by the Ministry of Foreign Affairs of the issuing country and these will have to be further attested by the Turkish Consulate. Otherwise, documents cannot be submitted to Turkish Governmental Bodies. We review all the documents and specify the approval procedure for each of our clients in detail, provide detailed consultancy on which authorities they will receive approvals from, and contact the Foreign Government Agencies as well as the Turkish Consulates if/when required.
o Filing the Documents
Filling in the application documents correctly is highly important. In case there is wrong information on the documents, then it may be required to bring a lawsuit in order to correct false information and it would cause the applicants to waste time and money. Applicants who do not work with a lawyer may struggle with the procedure for properly filling out and filing certain legal documents. These are other reasons why the applicants should work with a lawyer for the Turkish Citizenship Application Process.
o New Regulations
Although the Law is not be amended, there are always new regulations that are determined by the Application Authority. And if the applicant’s case is not suitable as per these regulations, then the application would be refused and the investment and citizenship application would be jeopardized. In order not to face such problems, the applicants should work with a lawyer who is in constant contact with the Application Authority and follows the latest developments on a regular basis. As Ketenci & Ketenci Lawyers, we duly follow the latest regulations and amendments for our clients to be on the safe side.
