Turkish Citizenship By Birth

As per Turkish Citizenship Law , Turkish Citizenship can be acquired by birth or after birth. This article intends to provide information on the citizenship of children who are born after the parents acquired Turkish Citizenship.

Turkish Citizenship by birth shall be automatically acquired on the basis of descent and it shall be effective from the moment of birth. According to the related Law and Regulations, Turkish Citizenship acquired by descent can be in the following situations:

1) A child born to a Turkish mother or through a Turkish father within the unity of marriage either in Turkey or abroad will be a Turkish Citizen.

2) A child born to a Turkish mother and through a foreign father within a non-marital relationship will be a Turkish Citizen.

3) A child born to a foreign mother and through a Turkish father within a non-marital relationship acquires Turkish Citizenship once the principles and procedures ensuring the establishment of descent are met.

Children born through a Turkish father within the unity of marriage will acquire the citizenship of the Republic of Turkey from the moment of birth. In this case, children will be registered in the household of the father. The fact that the child was born abroad or the child’s mother is a foreign citizen does not prevent the child from being a Turkish Citizen.

Children born to a Turkish mother either in Turkey or abroad will acquire the citizenship of the Republic of Turkey from the moment of birth. Those born within the unity of marriage will be registered in the mother's household of marriage, and those born within a non-marital relationship will be registered in the celibacy household of the mothers, based on the birth certificates.

Children born through a Turkish father and to a foreign mother within a non-marital relationship can acquire Turkish Citizenship if one of the following conditions are fulfilled:

  • According to Article 292 of Turkish Civil Code: Marriage of the child’s father and mother,
  • In accordance with Article 301 of Turkish Civil Code: Through the determination of paternity by the court upon the request of the mother or child;
  • In accordance with Article 295 of Turkish Civil Code, through acknowledgment of child.

Once the lineage relationship between the child and father is established, the child becomes a Turkish Citizen from the moment of birth.

According to Turkish Law and regulations, once the baby is born, the parents need to make a Notice of Birth for the baby. Normally notice of birth shall be made in 30 days after the birth for those residing in Turkey, and it shall be made in 60 days for those residing abroad. The birth notification can be made by the parents or agents with power of attorney.
